Welcome to Beacon. These Terms of Use (“Terms”) govern your access to and use of the Beacon mobile application (“App”) and related services. By using Beacon, you agree to these Terms. If you do not agree to these Terms, you may not use the App.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms, all applicable laws and regulations, and agree that you are responsible for compliance with any local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the App.

2. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To impersonate or attempt to impersonate Beacon, a Beacon employee, another user, or any other person or entity.
• To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which may harm Beacon or users of the App.
• To introduce any malicious or harmful software, viruses, or any other harmful content.

3. User Accounts and Submissions

• Account Registration: In order to access certain features of the App, you may be required to register for an account. You must provide accurate and complete information and update your account as needed.
• Business Listings: By submitting a business listing to the Beacon directory via the form or the app, you represent that you have the authority to share the information and that all information provided is accurate. You also consent to the business information being publicly listed on Beacon’s platform.
• Responsibility for Your Account: You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities that occur under your account.
• Termination: Beacon reserves the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms.

4. Intellectual Property Rights

The App and its original content, features, and functionality are and will remain the exclusive property of Beacon and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. You may not use Beacon’s trademarks or branding without prior written permission.

5. Business Listings

The Beacon App allows users to submit and browse business listings. Beacon is not responsible for the accuracy, completeness, or reliability of these listings. Listings are user-generated, and while we may review content for compliance with our guidelines, we are not obligated to do so.

• Listing Accuracy: Business owners are responsible for the accuracy of the information they submit. Beacon reserves the right to edit or remove listings that are deemed inappropriate or inaccurate.
• Listing Removal: Beacon reserves the right to reject or remove any listing at its discretion.
• Consent for Listing: By submitting a business listing, you consent to the public display of this information on the Beacon platform.

6. Disclaimer of Warranties

The App is provided on an “as-is” and “as available” basis. To the fullest extent permitted by law, Beacon makes no warranties, either express or implied, about the App, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Beacon does not warrant that the App will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Beacon and its affiliates, agents, licensors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses resulting from your access to or use of, or inability to access or use the App.

8. Modifications to the Terms

Beacon reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will notify you of changes by posting the new terms on this page. Your continued use of the App following the posting of any changes to these Terms constitutes acceptance of those changes.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, and you submit to the exclusive jurisdiction of the courts in that state.
